Introduction

Welcome to Designak! These Terms and Conditions (“Terms”) govern your use of the Designak mobile application and website (together referred to as the “Platform”), which connects clients with space designers in various fields including home, events, corporate, furniture, and architecture. This agreement becomes effective and binding as soon as you use the Designak Platform.

Definitions

For the purposes of these Terms and Conditions, the following terms shall have the meanings set forth below:

• Platform: Refers to the Designak mobile application and website.

• User: Any individual or entity accessing or using the Platform, including clients and designers.

• Client: A user seeking design services.

• Designer: A user offering space design services across various categories (home, events, corporate, furniture, architecture).

• Profile: The public-facing page created by a designer to showcase their work, services, and contact information.

• Content: Any images, text, media, or other materials uploaded or shared by users through the Platform.

• Premium Features: Paid features that offer enhanced visibility, analytics, and promotional tools for designers.

• Terms: Refers to these Terms and Conditions, including any policies or updates incorporated by reference.

Eligibility and Account Registration

Clients: All clients using the Designak Platform, whether with or without an account, must be at least 13 years old.

By using the Platform, you agree to comply with these Terms and to use the services responsibly.

If you choose to create an account, you must provide accurate and up-to-date information, and you are responsible for all activity under your account.

Designak reserves the right to restrict access, suspend, or terminate accounts or users who violate these Terms.

Designers: To register as a designer and create a public profile on Designak, you must be at least 18 years old.

You must be the owner of the profile and the actual service provider.

Creating a profile on behalf of another person or business is only permitted if you are their legal guardian or have their explicit written consent.

Creating profiles for third parties without authorization is strictly prohibited.

You must ensure all profile information is accurate and represents your real work and identity.

Misleading or impersonated profiles may be removed, and accounts may be suspended or terminated.

By registering an account, you also agree to our [Privacy Policy], which explains how your personal data is collected, used, and protected.

User Responsibilities

By using the Designak Platform, you agree to:

• Use the Platform in a lawful, respectful, and non-abusive manner.

• Refrain from posting false, misleading, or harmful content.

• Avoid impersonating others or misrepresenting your identity or services.

• Not upload content that violates copyright, privacy, or intellectual property rights.

• Respect the privacy of other users and refrain from collecting or misusing their personal data.

• Ensure that all communications through the Platform remain professional and appropriate.

• Promptly report any misuse, violations, or suspicious behavior to the Designak support team.

• For designers: Content uploaded to the platform must be relevant to space design services. Any unrelated materials — including promotions, non-design-related products, or personal ads — may be removed or result in account restriction.

Users are solely responsible for the content they upload or share through the Platform.

Designak reserves the right to remove or restrict any content that violates these Terms.

All users must also adhere to our [Privacy Policy] regarding the collection and handling of personal data shared through the Platform.

Designer Accounts and Content Guidelines 

Designers on Designak are responsible for creating and maintaining accurate, professional profiles that reflect their work and services. The following rules apply to all designer accounts:

• All information (name, category, description, location, etc.) must be truthful and up to date.

• Photos, videos, and captions shared in the profile must showcase your own work or your team’s work.

• You may not use stock images, AI-generated samples, or third-party content unless clearly labeled and authorized.

• Profiles must be relevant to space design services. Unrelated services or promotions (e.g. selling unrelated products, personal ads, or external businesses) are not allowed.

• Content must not contain offensive, inappropriate, or misleading material.

• Contact information added to the profile must be valid and professional (e.g., business email, portfolio link, phone number).

• Profiles that are inactive or incomplete for extended periods may be removed or hidden from search results.

Designak reserves the right to review, edit, hide, or remove any designer profile or content that violates these guidelines or does not align with the purpose of the platform.

Client Use and Contact Policy

Clients may use the Designak Platform to discover and connect with designers. Designer profiles may include contact information (such as phone numbers, emails, websites, or social media links) provided by the designer for direct communication.

• Designak does not offer or manage any booking, contracting, or payment between clients and designers.

• Any communication, agreement, or transaction that occurs outside the platform is solely between the client and the designer.

• Clients are expected to communicate with designers in a respectful and professional manner.

If a client encounters an issue with a designer, they may report the profile using the built-in reporting feature for our team to review the case.

Privacy and Data Usage

Your privacy is important to us. Designak collects and processes certain personal data as part of your use of the Platform. This includes, but is not limited to, information you provide during registration, profile setup, or general usage.

By using the Platform, you agree to the collection and use of your data as outlined in our [Privacy Policy].

The Privacy Policy explains what information we collect, how we use it, how we protect it, and your rights in relation to your data.

Intellectual Property Rights

All content, trademarks, logos, designs, and technology associated with the Designak Platform are the property of Designak or its licensors. You may not copy, modify, distribute, sell, or reproduce any part of the Platform without written permission.

 

Designers retain full ownership of the content they upload, including photos, text, and designs. However, by uploading content to the Platform, you grant Designak a non-exclusive, royalty-free license to use, display, reproduce, and promote that content within the Platform and its marketing materials, as long as your profile remains active.

 

You may not use or copy content from other users (e.g., designers or clients) without their explicit permission. Any misuse of intellectual property may result in removal of content or termination of your account.

Termination and Account Suspension

Designak reserves the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in any behavior that harms the platform, its users, or its integrity.

Your account may be suspended or removed for reasons including, but not limited to:

• Providing false or misleading information

• Sharing content unrelated to space design (for designers)

• Uploading offensive, illegal, or infringing content

• Impersonating others or misusing the platform

• Violating user privacy or community standards

 

You may also delete your account at any time through the app or by contacting support. Account deletion may result in permanent loss of data and content.

Disclaimers and Limitations of Liability

Designak provides the Platform “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or suitable for every user’s needs.

 

Designak is not responsible for:

• The quality, accuracy, or outcome of any services provided by designers

• Any agreements, transactions, or communications made between users

• Loss of data, profits, or damages resulting from use or inability to use the Platform

• Third-party content, links, or services accessed through the Platform

Governing Language

The Arabic version of this agreement is the official and legally binding text. Translations into other languages are provided for convenience only and shall not be relied upon in case of any conflict or discrepancy with the Arabic text.

Modifications to the Terms
Designak reserves the right to modify, update, or replace these Terms at any time.

If material changes are made, we will notify users through the Platform or by other appropriate means.

 

By continuing to use the Platform after the updated Terms take effect, you agree to be bound by the revised Terms. If you do not agree with the changes, you must stop using the Platform and may delete your account.

 

We encourage users to review the Terms regularly to stay informed about their rights and obligations.
